How many jury trials are there?

1.2% of federal civil cases go to trial

Statistics provided by the National Law Journal show that there are less and less jury trials.  For instance, in 1962, 11.5% of federal civil cases went to trial, compared with 6.1% in 1982, 1.8% in 2002 and 1.2% in 2009.  There are some factors to consider when it comes to the decreased number of jury trials.  First of all, lawyers have learned to measure which cases will be profitable.  Furthermore, clients are far more sophisticated about how they use lawyers.  Needless to say, companies are more experienced in risk management than they used to be.
