Facts About Divorce

A divorce is the legal termination of a marriage by a court through a legal proceeding requiring a petition or complaint for divorce. There are two main types of divorce: those are the fault and no-fault divorce. A fault divorce is based on marital misconduct.  A no-fault divorce requires no proof of misconduct; the requirement being testifying to an irretrievable breakdown of the marriage or irreconcilable differences.

Fact 1. Studies show that one’s age at marriage and income levels have strong correlations to divorce rates. The probability of the marriage not ending in divorce is higher for those who get married at a older age, have a college education, and earn a relatively higher income.

Fact 2.  Women who marry younger and divorce more frequently have been found to be African-Americans and Hispanic women from low-income families. The divorce rates amongst poor, African-American women exceed 50 percent.

Fact 3.   As to the duration of marriage, studies report that 10 percent of marriages end in divorce during the first 5 years and another 10 percent by the 10th year.

Fact 4.  The 2010 rate for divorce is 3.6 per each 1,000 in population or 0.72% of the population. The absolute number of divorcees is 872,000.

Fact 5.  Divorce rates in New Jersey indicate that marriages are likely to last longer for people who marry at an older age having a higher education and higher incomes.

Fact 6. In Brazil, there was an increase of 46 percent in divorces in 2011 as compared to the year before due to the legalization in shortening the time period for finalization of divorces. The total number of divorces recorded in 2011 was 350,000.

Fact 7. Military divorce rates have not exceeded the rate of civilian marriages despite the stress and away-from-home deployments incurring long periods of living apart.

Fact 8.  Factors attributing to the divorce rate amongst military personnel include the wartime salary, perks such as allowances and family support programs. The other factor could be the military culture of respecting institutions including marriage.

Fact 9. The decline in the divorce rate among couples in their 20s could be attributed to delayed marriages and the increased courting period.  Amongst middle-age couples, the reasons for divorce rates include: familial matters, incompatible personalities, and irreconcilable differences. There were also situations of couples living in different locations which contributed to the divorce.

Fact 10. There are states such as Nevada and California where the divorce process is easier than in East Coast states such as Massachusetts, New York, Pennsylvania, and Maryland. This has given rise to the situation where couples from the East Coast would prefer to have their divorce finalized in Nevada.

    Divorce causes major issues with health insurance benefits. Many families have employer provided and/or paid for health insurance benefits that cover the entire family. It is not uncommon to see situations where the other spouse is a stay at home parent, with absolutely no access to health insurance benefits, or employed at a job with either no health insurance benefits available or those benefits available at a substantial cost. After a divorce, the spouse with the family health insurance coverage can no longer cover the other parent. They are no longer “family” members who can take advantage of one health insurance policy. How to then ensure that everyone stays insured does become an issue for negotiation and/or divorce litigation…;
